ONDA v. U.S. Dep't of the Interior, 07-381-MO (Bully Creek Pasture closure decision)

Case Number: 07-381-MO
Filed on: 2007/03/14
Filed by: Kristin Ruether & Mac Lacy

March 14, 2007

Challenge seeking to enforce a BLM decision that immediate action is needed to protect Bully Creek from chronic overgrazing.

Mar. 21, '08 - ONDA moves to intervene in permittee's 2008 administrative appeal of BLM closure decision.

Feb. 7, '08 - BLM issues final decision closing Bully Creek Pasture to grazing in 2008.

Jan. 11, '08 - ONDA sends letter to BLM requesting that agency close Bully Creek Pasture to 2008 grazing based on continuing violations of ecological standards.

May 17, '07 - Court dismisses ONDA's case, ruling from the bench that permittee monitoring, when held up against BLM's 2006 monitoring data supporting agency's closure decision, provided at least a "scintilla" of evidence to support administrative law judge's decision to stay BLM's 2007 pasture closure decision.

Mar. 30, '07- ONDA files a Motion for Temporary Restraining Order and/or Preliminary Injunction, requesting that the court bar the Department of Interior from authorizing any livestock grazing on the Bully Creek Pasture in 2007. See memo in support.

Mar. 14, '07- ONDA and WWP file suit against Department of Interior for allowing livestock grazing to continue along Bully Creek, without implementing an immediate pasture closure that BLM determined is necessary to prevent imminent harm to riparian resources.
