November 4, '02-In a case stemming from ONDA's petition to list the Great Basin redbound trout, the 9th Circuit Court agrees with ONDA's challenge of the U.S. Fish & Wildlife Service's practice of delaying, often for years, findings on Endangerd Species Act petitions. The court also held that when FWS misses ESA-imposed deadlines, the court must issue an injunction ordering FWS to make the determinations. View the case. (PDF* 109K).
